The examination and approval of construction projects concerning environmental protection

Department undertaking procedures:

Procedures for Examination and Approval:

(1)To decide whether to accept the application and the level of the environmental impact assessment.

(2)The applicant entrust the assessment department with the report (or statement) or registration form making of environmental impact assessment.

(3)To examine and approve.

Conditions for Examination and Approval:

(1)The construction of the project complying with the related state and local laws, rules, regulations, and requirements on industrial policies, which doesn’t related to the project or industry forbidden by the state or local law, and doesn’t utilize the  national forbidden and washed out equipments or materials.

(2)The site selection for the project meeting the requirements specified in the urban construction planning and the environment programming.

(3)The damage to the ecological environment  and the pollution brought out by the construction project may be prevented or father, the disposal of contaminants and pollutants complying with the related standards and specifications on disposals after the project is finished, the impact on the surroundings beyond the state permission.

(4)The disposal of contaminants and pollutants is beyond the  gross standards.

(5)The contents of materials such as the  forms, reports or statements complying with the actual conditions of the projects and with the specified standards or norms with information fully supplied in details.

Information Materials Needed for Verification Procedures:

(1) The advice report on project .

(2)The replying to the advice report on project.

(3)Advice on selected site.

(4)Report (or Statement) or registration form for environmental impacts.

(5)The first comment on environment impact assessment of the local environmental protection department or the major management department.

Time Limits for Examination & Approval:
The examination & approval procedures for the reports on environment impacts, statements, and registration forms shall be completed within 15, 10 and 7 days respectively counting from the date of acceptance of the reports, statements or registration forms (if some supplementary information is involved, the time limit starts counting from the date when these information materials are fully supplied).
